Consumer Health Data Privacy Policy
Pearson VUE, a business of NCS Pearson, Inc. (“Pearson VUE”) is committed to respecting your privacy. Our Privacy and Cookies Policy (“Privacy Policy”) describes how we handle your personal data generally. This supplemental Consumer Health Data Privacy Policy (“Health Privacy Policy”) explains our practices for “Consumer Health Data” as such term is defined by laws including Washington’s My Health My Data Act (“MHMDA”) and other U.S. health privacy laws, as each are amended and as and when they become effective including any regulations thereunder (“U.S. Health Privacy Laws”).
Categories of Consumer Health Data We Collect
“Consumer Health Data” means personal information that is linked or can reasonably be linked to a consumer and that identifies past, present, or future physical or mental health status as defined under the U.S. Health Privacy Laws.
As described in our Privacy Policy, the data we collect depends on the context of your interactions with Pearson VUE, the choices you make, and the products and features you use. Pearson VUE only collects, uses, and discloses Consumer Health Data from you as needed to provide you with the products or services you request with your consent and as directed by your test sponsor.
Pearson VUE may collect Consumer Health Data related to the following categories of Consumer Health Data:
- Individual Health Conditions, Treatment, and Diagnoses. We may need to collect this type of information if you choose to submit an accommodations request.
- Biometric Data. Depending on the products you use and when directed to do so by your test sponsor, Pearson VUE may rely upon biometric technology such as palm vein scans and or comparisons of facial geometry and data generated by those processes to verify a test taker’s identity, to identify proxy test takers, prevent fraud, and/or ensure the security and integrity of the test. Disclosures of Consumer Health Data
We do not sell, lease, trade, or otherwise profit from your Consumer Health Data. Pearson VUE may disclose Consumer Health Data:
- To your test sponsor for purposes consistent with this policy and our Privacy Policy and the requirements for exam administration set by your exam sponsor;
- To service providers involved in supporting or providing biometric verification or accommodations services for Pearson VUE;
- Based upon your having provided advance consent;
- In connection with the establishment, exercise, or defense of legal claims; or
- When required by law or pursuant to a valid warrant, subpoena, or court order.
Your Privacy Rights
The Laws provide the following rights with respect to Consumer Health Data we collect about you:
- Right to Access / Confirm: You may have the right to confirm whether we are collecting, sharing, or selling Consumer Health Data about you and with whom we may be disclosing such Consumer Health Data, and to access such data.
- Right to Withdraw Consent: If you have provided your consent for our processing or sharing of your Consumer Health Data, you may have the right to withdraw your consent.
- Right to Delete: You may have the right to request that we delete your Consumer Health Data and that all third parties to whom we have disclosed your Consumer Health Data delete such data.
How to Exercise Your Privacy Rights
The U.S. Health Privacy Laws provide certain rights to some consumers with respect to Consumer Health Data. You can request to exercise such rights using the various tools and mechanisms as described the “Your Rights and Responsibilities” section of our Privacy Policy.
If your request to exercise a right under the U.S. Health Privacy Laws is denied, you may appeal that decision by contacting us at PearsonVUEContracts@pearson.com. If the appeal is unsuccessful, you may be able to raise a concern or lodge a complaint with the applicable State Attorney General:

Changes to our Consumer Health Data Privacy Policy
We reserve the right to amend this Health Privacy Policy at our discretion and at any time. When we make changes to this Health Privacy Policy, we will post an updated Health Privacy Policy on our website and update the Health Privacy Policy’s last updated date.
